The Business Licensing Authority

The Business Licensing Authority (BLA) is an independent statutory authority established under the Business Licensing Authority Act 1998. The BLA administers the licensing and registration provisions of various business licensing legislation in Victoria.

The BLA is responsible for determining licensing and registration decisions. Members act autonomously, however meet on a regular basis to ensure consistency in decision making and co-ordination of relevant issues.

Role and Functions of the BLA

The BLA is empowered under the below legislation to grant or refuse occupational licensing and registration applications; allow otherwise disqualified persons to be involved in certain industries if not contrary to the public interest; and impose conditions or restrictions on licensees and registrants if deemed necessary to protect consumer or public interests-

  • Conveyancers Act 2006
  • Estate Agents Act 1980
  • Motor Car Traders Act 1986
  • Owners Corporation Act 2006
  • Rooming House Operators Act 2016
  • Second Hand Dealers and Pawnbrokers Act 1989
  • Professional Engineers Registration Act 2019
  • Australian Consumer Law and Fair Trading Act 2012 (debt collectors and introductions agents)

The Motor Car Traders Claims Committee

The Motor Car Traders Claims Committee (MCTCC) is established under the Motor Car Traders Act 1986 to determine compensation claims made against the Motor Car Traders' Guarantee Fund (MCTGF).

The BLA and MCTCC are supported in their functions and operations by Consumer Affairs Victoria and the Department of Government Services (DGS).

About the role

The BLA’s governance arrangements are set out in the Business Licensing Authority Act 1998 and the Public Administration Act 2004.

The BLA consists of a Chairperson and Deputy Chairperson who are required to be legal practitioners of at least five years standing and one other member who has qualifications and experience in the field of professional engineering. All BLA members are appointed by the Governor in Council.

The Deputy Chairperson of the BLA and Chairperson of the MCTCC is a part time role.

As the Deputy Chairperson of the BLA, you will be responsible for determining licensing and registration decisions autonomously, however confer regularly with the Chairperson of the BLA s to ensure consistency in decision making and co-ordination of issues across different regulatory regimes..

As Chairperson of the MCTCC, you will be responsible for chairing MCTCC meetings and determining the outcome of claims on the MCTGF in collaboration with consumer and industry representatives.

Who we're looking for

Suitable candidates are required to contribute effectively to the Committee and demonstrate:

  • A legal practitioner of at least 5 years standing with experience in administrative and commercial law. Knowledge of consumer law, criminal law and litigation an advantage;
  • A proven ability to make lawful, high quality decisions and develop practical solutions in the operation of consumer-based regulation;
  • An understanding of the operations of Government administration and an interest and experience in policy development, legislative process and regulation;
  • A proven capacity to provide high quality advice in a complex regulatory environment;
  • Demonstrated high level management, leadership and interpersonal skills;
  • Demonstrated communication and presentation skills;
  • An ability to work under pressure and prioritise workloads.

Mandatory requirements

Qualifications in law is essential, including relevant industry experience.
