HIV Case Advisory Panel Overview
The HIV Case Advisory Panel is a non-statutory departmental committee established to provide the Chief Health Officer with expert advice regarding the powers outlined in sections 117 and 118 of the Public Health and Wellbeing Act 2008, specifically as they relate to HIV. The panel consists of individuals independent of the Department of Health.
Ethical and Legal Considerations
Invoking the law to manage risk behaviours presents a wide range of complex ethical and legal issues. The disease control powers vested in the Chief Health Officer or their delegate under the Public Health and Wellbeing Act 2008 encompass various public health measures, including:
These powers are distinct from those outlined in the Crimes Act 1958 and aim to balance community protection with the rights of individuals.
Role and Function of the Panel
As outlined in the Guidelines, the HIV Case Advisory Panel serves as one of several advisory sources considered by the Chief Health Officer. The panel's independent experts provide guidance on actions needed to evaluate and contain public health risks, promoting sustainable behavioural changes in individuals using the least restrictive methods available.
Meeting Frequency and Support
The Panel typically meets quarterly but can convene urgently when immediate advice is required for specific individuals or cases. It is supported by the Victorian Investigation of Complex STIs (VICS) Team. Recommendations from the Panel are usually directed to the Chief Health Officer or their delegate during regular meetings or urgent case management discussions.
Membership and Confidentiality
Members are appointed for a term of three years and may be reappointed. They are selected based on their expertise and ability to represent community interests, without advocating for any affiliated organisations.
