Purpose
The BAB is established under section 166(1) of the Building Act 1993 (the Act) to determine any matter relating to the Building Regulations 2006 (the Regulations), the Building Code of Australia and specified provisions of the Act.
Part 10 of the Act specifies the jurisdiction of the BAB. This includes making determinations to waive, modify or vary the provision of particular regulations based upon the particular case, determining that a particular design or element of a building complies with the Act and the Regulations, and hearing appeals and disputes in relation to building control matters including appeals against building surveyors or local councils.
